Terms and Conditions

The following terms and conditions apply to bookings made with Michael Rinn/Vertikale Welten (hereinafter referred to as “instructor/trainer/coach”). Participants and groups are defined as anyone who has made a booking either by paying a deposit, the full amount or by taking part in an activity offered. Where an individual is booking on behalf of others, the group’s acceptance of these terms and conditions is given through the booking organiser.

Medical Declaration

It is the responsibility of the participant to declare any pre-existing medical conditions or injuries prior to the start of the activity.

During the activity, the participant is responsible to notify of any medical problems.

Working with under 18s and vulnerable adults

The activities are designed for adults, therefore I ask for your date of birth when booking.

The instructor/trainer/coach can only work with under 18s if they are accompanied by their parent or legal guardian.

Decision making and venues

The decision of the instructor/trainer/coach is final and is made for safety reasons and based on the needs of the participants. It may lead to a change in the objective of the day or the planned activity.

The instructor/trainer/coach will choose a venue which best achieves the aims of the individual or group with the given weather and conditions. This may not be the activity or place which was envisage, or advertised. It may be an climbing gym or a low level option or a skills based option. Any additional costs, such as climbing gym entry are met by participants.

Kit

A kit list is provided to all participants. If a participant is not deemed to be adequately equipped then the activity may have to be modified.

Personal losses, damage or wear and tear to kit are not covered.

In the event of loss or damage to instructor/trainer/coach kit and equipment due to negligence or lack of care, the costs may be claimed back from the participant or the group.

Payment

A minimum of a prior agreed deposit is required to secure the dates or an activity place. Full payment is required a minimum of 4 weeks before the start date.

Cancellation policy

If the instructor/trainer/coach has to cancel an activity, participants will be notified immediately and will be offered the choice of a reschedule or a full refund.

If you as a participant have to cancel, you must inform the instructor/trainer/coach as soon as possible. If the place can subsequently be filled, a refund (minus booking fees) can be paid. It is recommended taking insurance to cover unforeseen events like illness.

Cancellations up to 4 weeks before the activity will receive a full refund (minus booking fees); less than 4 weeks a refund minus the deposit and booking fees. Between 4 and 2 weeks before the activity a 50% refund; less than 2 weeks before the activity date no refund.

Risk

The activities and environment in which the instructor/trainer/coach operates involve inherent risks, including the risk of serious injury or death.

The instructor/trainer/coach reduces but cannot eliminate this risk.

Participants understand that climbing and mountaineering are activities that involve a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and take responsibility for their own actions.

Limitation of liability

With the exception of liability for intent or gross negligence to be proven by participants, any liability towards the instructor/trainer/coach is limited. Any further compensation, in particular for loss of profit, consequential harm caused by a defect, indirect damage, damage suffered by third parties is completely excluded. The parties irrevocably acknowledge the adequacy of the liability provision in this section.

Place of fulfilment, law and language

Place of fulfilment for both parties is 35390 Gießen. German law and German language shall apply.

Severability clause

The invalidity of one or more of the above provisions shall not affect the validity of the remaining provisions.
